Additional Policies

The use of Nan Resources LLC services and facilities is at your own risk. Nan Resources LLC disclaims all warranties of merchantability and fitness for a particular purpose. Nan Resources LLC shall not be liable for any loss or data loss, or any other commercial damage, including special, incidental, consequential, or other damages.

By utilizing any services or facilities provided by Nan Resources LLC, you acknowledge and accept that you are doing so at your own risk. Nan Resources LLC explicitly disclaims all warranties of merchantability and suitability for a specific purpose. Under no circumstances will Nan Resources LLC be held responsible for any loss, data loss, or other commercial damages, including but not limited to special, incidental, consequential, or other damages.

You, as the customer, agree to defend, indemnify, protect, and hold Nan Resources LLC blameless from any and all demands, liabilities, losses, expenses, and claims, including reasonable attorney’s fees, directed against Nan Resources LLC, its agents, customers, officers, and employees, that may arise or result from any service rendered or agreed to be performed or any product sold by you, your agents, employees, or assigns. You also agree to defend, indemnify, and hold Nan Resources LLC harmless from liabilities stemming from any injury to individuals or property caused by any products sold or distributed in association with Nan Resources LLC’s server.

Nan Resources LLC retains the right to intervene with any of the websites hosted on its servers for the benefit of its customers. The customer is responsible for any materials provided that infringe or are alleged to infringe upon the proprietary rights of a third party, including copyright infringement or any defective products sold to the customer via Nan Resources LLC’s server. Nan Resources LLC has the sole authority to determine what constitutes a violation of this policy.

Your account will be set up after we have received payment and screened the order(s) for potential fraud, in collaboration with our payment partner(s). It is your responsibility to provide us with an email address that does not use the domain(s) you are registering with our services. In the event of an abuse issue or if we need to contact you, we will use the primary email address on file. You are responsible for keeping this email address up to date at all times. Providing false contact information may lead to the termination of your account.

For dedicated server purchases or transactions deemed high risk, you may be required to provide government-issued identification and/or a scan of the credit card used for the purchase. If you do not comply with these requirements, the order may be considered fraudulent and denied.

All services provided by Nan Resources LLC must be used for lawful purposes only. You agree to indemnify and hold harmless Nan Resources LLC from any claims resulting from your use of our services. Our services must not be used to infringe on any copyright or trademark, which includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. Offering counterfeit merchandise for sale will result in the immediate termination of your account. If you believe your copyright or trademark is being infringed upon, please email [email protected] with the required information. A list of the required information can be found here. For licensing issues, further documentation may be necessary.

Examples of prohibited material on our servers:

  • IRC Bots

  • Proxy Scripts / Anonymizers

  • Pirated Software / Warez

  • Image, file dump, mirror, or banner-ad services (e.g., Rapidshare, Photobucket, commercial banner ad rotation)

  • Affiliate servers, topsites

  • Commercial audio streaming (more than one or two streams)

  • Escrow, High-Yield Interest Programs (HYIP) or related sites

  • Investment sites (FOREX, egold exchange)

  • Sale of any controlled substance without an appropriate permit(s)

  • AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites

  • MUDs / RPGs, hate sites, hacker-focused sites/archives/programs, or sites promoting illegal activities

  • IP Scanners, Brute Force Programs, Mail Bombers, Spam Scripts

  • Forums or websites distributing or linking to warez content

We reserve the right to deny service to anyone. Any material deemed obscene or threatening is prohibited and may be removed from our servers with or without notice.

Failure to reply to an email from our abuse department within 48 hours may result in suspension or termination of your services. All abuse issues must be addressed via a trouble ticket/email, with a response expected within 48 hours.

Hosting content intended to deceive or impersonate another entity, collecting usernames or passwords from unsuspecting users, is illegal and not allowed on our servers. Any account with phishing content may be suspended with or without notification.

If you are unsure about the acceptability of your site or service, contact us at [email protected] for assistance. Content causing potential harm to minors, including but not limited to child pornography or content perceived as such (e.g., Lolita), is strictly prohibited. Any site found hosting or linking to child pornography will be suspended immediately without notice, and violations will be reported to the appropriate law enforcement agency.

You are responsible for ensuring the security of scripts/programs installed under your account and proper directory permissions, regardless of the installation method. Whenever possible, set directory permissions to 755 or as restrictive as possible. You are responsible for all actions taken under your account, including compromised credentials like usernames and passwords. Use of a secure password is mandatory; weak passwords may result in account suspension until a more secure password is agreed upon. We may conduct audits to prevent weak passwords; if your password is found to be weak during an audit, we will notify you and allow time for you to change/update your password.

We have a zero-tolerance policy regarding the sending of unsolicited emails, bulk emailing, and spam. “Safe lists” and “double opt-in” will be treated as spam. Any user found sending spam will have their account terminated with or without notice. Please refer to our mail policy for a comprehensive mail policy.

Websites promoted via spam (spamvertised) are not permitted on our servers. This includes but is not limited to, spam sent through fax, email, instant messaging, or USENET/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account causing our IP space to be blacklisted will be immediately suspended and/or terminated.

Nan Resources LLC reserves the right to mandate changes or disable any website, account, database, or other components that fail to comply with its policies, or to make such modifications in an emergency at its sole discretion. Nan Resources LLC also reserves the right to charge the account holder responsible for sending unsolicited emails a cleanup fee, the cost of which is determined solely by Nan Resources LLC.

By using Nan Resources LLC’s services, you agree to provide appropriate payment in advance for the services received. You also agree that unless you notify Nan Resources LLC of your intention to cancel any or all services, they will be billed on a recurring basis.

Our billing system will not automatically apply any credit on your account to outstanding invoices at the time the credit was issued. It is your responsibility to log in to our client area and apply any credit on your account to any due invoice or new order. Unless explicitly requested, we will not apply credits to due invoices. We will not refund a credit applied to one of your services/domains if it has been applied for more than 24 hours unless the credit was insufficient to maintain the account/service without automatic suspension for non-payment. As a Nan Resources LLC client, you are responsible for ensuring that all check payments are made to our bank account. We will not pick up check payments from a client’s facility. Your account will only be credited once the check payment clears in our bank account, and domain name registrations paid by check will only be processed after the check clears.

To expedite the crediting process, please indicate your primary domain with us on your payment. If this information is not provided, you will need to send us a scanned copy of the payment receipt.

Cancellations must be submitted in writing via the Client area. Upon receiving your cancellation request and verifying all necessary information via email, we will confirm your account cancellation. If you do not receive a confirmation email, please get in touch with us immediately.

It is your responsibility as a client to ensure that your payment information is up to date and that all invoices are paid on time.

For dedicated server services, we offer a 48-hour grace period from the invoice due date for full payment.

Invoices paid multiple times with multiple PayPal Subscriptions can only be added as an account credit and cannot be refunded via PayPal. If you need assistance, please contact [email protected]. Nan Resources LLC reserves the right to change monthly payment amounts and other charges at any time.

Your use of the service is entirely at your own risk. Nan Resources LLC is not responsible for any files or data residing on your account. You agree to assume full responsibility for the transfer of files and data, as well as maintaining proper backups of all files and data stored on Nan Resources LLC servers.

This Cancellations and Refunds Policy (“Policy”) outlines the procedures and conditions under which Nan Resources LLC (“Company”, “we”, “us”, or “our”) will process requests for cancellations and refunds of the web hosting services provided by us. Please read this Policy carefully to understand your rights and obligations.

  1. 30-Day Money Back Guarantee

We offer an unconditional 30-day money-back guarantee on our managed shared hosting and reseller hosting plans. If you are not satisfied with our services within the first 30 days of your contract, you may request a full refund by contacting our customer support team.

  1. Exclusions

Our 30-day money-back guarantee does not apply to dedicated or Virtual Private Server (VPS) hosting plans.

  1. Non-Refundable Payment Methods

Refunds will not be provided for payments made through the following methods: Check, Wire transfers, or Western Union. We strongly recommend using a refundable payment method when purchasing our services.

  1. Cancellation Requests

To request a cancellation, please contact our customer support team via email, phone, or live chat. Your request must include your account information, the reason for cancellation, and a clear statement of your intention to cancel the service. We will process your cancellation request within 72 hours of receiving it.

  1. Refund Processing

Once your cancellation request has been approved and processed, we will issue a refund within 5-7 business days to the original payment method used for the purchase. Please note that it may take additional time for the refund to be reflected in your account, depending on your bank or payment provider.

  1. Violations of Terms of Service

Any violations of our Terms of Service will result in the forfeiture of your right to a refund under this Policy. This includes but is not limited to, activities such as spamming, illegal content hosting, or other actions that harm our network or violate our acceptable use guidelines.

  1. Introduction

This Resource Usage Policy (“Policy”) sets forth the guidelines and restrictions for the use of server resources provided by Nan Resources LLC (“Company”, “we”, “us”, or “our”) to its customers (“Customer”, “you”, or “your”) for web hosting services. Our goal is to provide reliable and high-quality hosting services to all our customers. This Policy is designed to ensure that our services are used responsibly and do not negatively impact the performance of our servers or other customers’ websites.

  1. Acceptable Use of Resources

You are responsible for ensuring that your use of our server resources complies with this Policy. This includes, but is not limited to, the following:

a) CPU and Memory Usage: Your account should not consistently utilize excessive CPU or memory resources that may impact the performance of our servers or other customers’ websites. We reserve the right to suspend or terminate accounts that consistently exceed the acceptable usage limits.

b) Disk Space: The disk space provided with your hosting plan should be used primarily for website content, including files, images, and databases. It should not be used for the storage of backups, archives, or other non-web-related content.

c) Bandwidth: Your account should not consume excessive bandwidth that could negatively affect the performance of our network or other customers’ websites. We reserve the right to throttle, suspend, or terminate accounts that consistently exceed the acceptable usage limits.

d) Email: Our email service should be used for lawful and legitimate purposes only. You are prohibited from sending unsolicited bulk or commercial messages (spam) or engaging in any activities that may compromise the security or integrity of our email servers.

  1. Prohibited Activities

The following activities are strictly prohibited and may result in immediate suspension or termination of your account without refund:

a) Using our services to host or distribute any illegal content, including but not limited to copyrighted material, child pornography, or content promoting hate speech, violence, or discrimination.

b) Engaging in any activities that disrupt, degrade, or otherwise negatively impact the performance of our servers or network, including but not limited to DDoS attacks, hacking attempts, or the distribution of malware or viruses.

c) Operating an open proxy, open mail relay, or using our services for anonymizing network traffic.

  1. Enforcement

We reserve the right to monitor and investigate potential violations of this Policy. If we determine that a violation has occurred, we may take any appropriate action, including but not limited to suspension or termination of your account, without prior notice. We also reserve the right to cooperate with law enforcement agencies in the investigation of any suspected illegal activities.

  1. Changes to the Policy

We may revise this Resource Usage Policy at any time, at our sole discretion. We encourage you to periodically review this Policy to stay informed of any changes. Your continued use of our services after any changes to this Policy constitutes your acceptance of the updated terms.

If your shared or reseller server experiences physical downtime outside the 99.9% uptime guarantee, you may be eligible for a one-month credit on your account. The approval of the credit is at Nan Resources LLC’s discretion, based on the justification provided. Third-party monitoring service reports may not be used for justification due to factors such as the monitor’s network capacity and transit availability. The server’s uptime is defined by the reported uptime from the operating system and the Apache Web Server, which may differ from the uptime reported by other individual services. To request a credit, please email [email protected] with a justification. All requests must be submitted in writing via email. The uptime guarantee applies only to shared and reseller solutions. Dedicated servers are covered by a network guarantee, where the credit is prorated for the downtime duration not related to our uptime guarantee.

Resellers are accountable for providing support to their clients, as Nan Resources LLC does not offer support directly to resellers’ clients. If a reseller’s client contacts us, we reserve the right to place the client’s account on hold until the reseller can fulfill their support obligations. All support requests must be submitted by the reseller on behalf of their clients for security reasons. Additionally, resellers are responsible for all content stored or transmitted through their reseller account and their client’s actions. Nan Resources LLC will hold resellers accountable for any violations of the law or terms of service committed by their clients.

Shared accounts are not permitted to resell web hosting services to others. If you intend to resell hosting, you must use a reseller account.

For the purpose of conducting security audits as required by our data center, Nan Resources LLC reserves the right to change the password on a dedicated server if the current password on file is outdated. It is the client’s responsibility to ensure a valid email address and an up-to-date root password are on file for their dedicated server to prevent downtime caused by forced password resets. Nan Resources LLC reserves the right to conduct server audits as needed and to perform administrative actions upon the request of our data center. Clients are responsible for backing up dedicated servers. We do not back up dedicated or Cloud servers.

The hosting fee you pay will remain constant from the date of purchase. However, we reserve the right to modify the prices listed on our website and increase the resources allocated to plans at any time.

By using any Nan Resources LLC services, you agree to submit to binding arbitration. If any disputes or claims arise against Nan Resources LLC or its subsidiaries, such disputes will be handled by an arbitrator of Nan Resources LLC’s choice. An arbitrator from the American Arbitration Association or the National Arbitration Forum will be selected in the state of Texas. Arbitrators shall be attorneys or retired judges and shall be selected pursuant to the applicable rules. All decisions rendered by the arbitrator will be binding and final. The arbitrator’s award is final and binding on all parties. The Federal Arbitration Act, and not any state arbitration law, governs all arbitration under this Arbitration Clause. You are also responsible for any and all costs related to such arbitration.

We may disclose customer information to law enforcement agencies when presented with a valid and legally binding request, such as a subpoena, court order, or search warrant without further consent. We will make reasonable efforts to verify the authenticity and validity of any legal requests we receive and to ensure that they comply with applicable laws and regulations.

Our transfer team will do their best to help you move your site to us, but we cannot guarantee the transfer process. This is a courtesy service, and we cannot guarantee its availability or the time it may take, as each host has different configurations. We will make every effort to assist you, but in some cases, we may be unable to help you transfer data from your old host.

Nan Resources LLC is not responsible for any claimed damages, including incidental and consequential damages, that may result from our servers going offline or being unavailable for any reason. Additionally, Nan Resources LLC is not responsible for any claimed damages, including incidental or consequential damages, arising from the corruption or deletion of any website on our servers. All damages shall be limited to the immediate termination of service.

Nan Resources LLC reserves the right to revise its policies at any time without notice.

Nan Resources LLC is not liable for system downtime, crashes, or data loss. We cannot be held responsible for any projected profits a client may have gained if their site was operational. Some services provided by Nan Resources LLC are resold, meaning certain equipment, routing, software, and programming used by Nan Resources LLC are not directly owned or created by Nan Resources LLC. Additionally, Nan Resources LLC assumes no responsibility for the use of our clients’ accounts. If any terms or conditions are not adhered to, the account in question will be automatically deactivated. We reserve the right to remove any account without prior notice for any reason, without restitution, as Nan Resources LLC deems appropriate. Furthermore, Nan Resources LLC reserves the right to modify any or all of the above Policies, Guidelines, and Disclaimers without notification.
